This Terms & Conditions of Use Agreement (“Agreement” or “Terms”) is entered into between My Eco Farms, operated by My Eco Mart (“Company”, “we”, “our”, or “us”), and any individual or entity (“User”, “Customer”, or “you”) accessing or using our website and/or mobile application (collectively, the “Platform”).
By accessing or using the Platform, you expressly agree to be bound by this Agreement and all associated policies, including but not limited to the Privacy Policy, Refund Policy, and Cancellation Policy (collectively, the “Policies”). If you do not agree to these Terms, you must immediately discontinue use of the Platform.
1. Definitions
1.1 “Agreement” means these Terms & Conditions, together with all referenced Policies.
1.2 “Platform” means the My Eco Mart website, mobile application, and related digital services.
1.3 “Product” means any goods offered, listed, or supplied by the Company.
1.4 “Service” means all features, facilities, support, or functionality provided through the Platform.
1.5 “User” / “Customer” means any person who accesses, browses, or uses the Platform.
1.6 “Customer Account” means the registered account required to access Services or purchase Products.
1.7 “Force Majeure Event” means circumstances beyond reasonable control as described in Clause 13.
2. Eligibility
2.1 Users must be at least 16 years of age and possess legal capacity under applicable law.
2.2 The Platform shall not be used by:
Users previously suspended or terminated by the Company;
Users prohibited from using such services under applicable law.
2.3 By using the Platform, you represent and warrant that you meet all eligibility requirements.
3. Customer Account Responsibilities
3.1 Registration of a Customer Account may be required to purchase Products or access certain Services.
3.2 You are solely responsible for:
Maintaining accurate and current account information;
Safeguarding login credentials;
All activities conducted through your account, whether authorized or unauthorized.
3.3 The Company shall not be liable for losses arising from unauthorized access due to User negligence.
4. Interpretation
4.1 Words in the singular include the plural and vice versa.
4.2 References to any gender include all genders.
4.3 References to laws include amendments and re-enactments.
4.4 Clause headings are for convenience only and shall not affect interpretation.
5. Orders, Acceptance & Errors
5.1 Orders placed on the Platform constitute an offer by the User.
5.2 An order shall be deemed accepted only upon dispatch or fulfillment by the Company.
5.3 The Company reserves the right to:
Reject or cancel orders due to unavailability, pricing errors, or suspected fraud;
Correct typographical, technical, or pricing errors without liability.
5.4 Payments must be completed through Company-approved payment methods only.
6. Modifications to Terms
6.1 The Company may amend these Terms or any Policies at its discretion, with or without prior notice.
6.2 Continued use of the Platform constitutes acceptance of the revised Terms.
7. Permitted Use & Restrictions
7.1 The Platform is intended solely for personal and non-commercial use.
7.2 Prohibited activities include, without limitation:
Unauthorized access, hacking, scraping, or reverse engineering;
Impersonation or identity misrepresentation;
Competitive data extraction or market research;
Uploading malware or harmful code;
Any unlawful, fraudulent, defamatory, or obscene activity.
7.3 The Company reserves the right to suspend or terminate accounts at its sole discretion.
8. Product Descriptions & Images
8.1 While reasonable efforts are made to ensure accuracy, the Company does not warrant that Product descriptions or images are error-free.
8.2 Product images are illustrative in nature; actual Products may vary.
8.3 Users acknowledge and accept such variations and waive claims based on minor discrepancies.
9. Third-Party Links
9.1 The Platform may contain links to third-party websites.
9.2 The Company does not control or endorse third-party content.
9.3 Access to third-party sites is at the User’s own risk.
10. Intellectual Property Rights
10.1 All intellectual property associated with the Platform, including content, trademarks, software, and design, belongs exclusively to the Company or its licensors.
10.2 Unauthorized copying, modification, distribution, or commercial use is strictly prohibited.
10.3 Violations may result in legal action and damages.
11. Refunds & Cancellations
Refunds and cancellations are governed exclusively by the Company’s Refund Policy and Cancellation Policy, which form an integral part of this Agreement.
12. Limitation of Liability
12.1 To the maximum extent permitted by law:
All warranties, express or implied, are disclaimed;
The Company shall not be liable for indirect, incidental, or consequential damages;
Total liability shall not exceed the amount paid by the User for the relevant Product or Service.
12.2 Nothing herein limits liability for fraud, gross negligence, or personal injury caused by negligence.
13. Force Majeure
The Company shall not be liable for failure or delay due to Force Majeure Events, including but not limited to natural disasters, pandemics, strikes, regulatory actions, cyber incidents, or infrastructure failures. Obligations shall remain suspended for the duration of such events.
14. Indemnification
The User agrees to indemnify and hold harmless the Company and its affiliates from all claims, losses, damages, liabilities, and expenses arising from:
Breach of this Agreement;
Misuse of the Platform;
Violation of laws or third-party rights.
15. Termination
15.1 The Company may suspend or terminate access at its discretion for violation of these Terms.
15.2 Upon termination, all User rights cease immediately.
15.3 Clauses relating to intellectual property, liability, indemnity, and governing law shall survive termination.
16. Governing Law & Dispute Resolution
16.1 This Agreement shall be governed by the laws of India.
16.2 Courts located in Tamilnadu, India, shall have exclusive jurisdiction.
16.3 At the Company’s option, disputes may be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996.

17. Order Cancellation Rights
17.1 Company Discretion:
My Eco Mart reserves the absolute right to cancel any order, including COD orders, without assigning reasons.
17.2 Grounds for Cancellation:
Orders may be canceled due to incomplete information, prior delivery refusals, suspicious ordering behavior, operational constraints, or other business considerations.
17.3 Notification:
Customers will be informed of cancellations in a reasonable manner.
17.4 Non-Liability:
The Company shall bear no liability for exercising its cancellation rights.
18. Miscellaneous
18.1 Assignment: Company may assign rights freely; Users may not without consent.
18.2 Severability: Invalid provisions shall not affect remaining clauses.
18.3 No Waiver: Failure to enforce rights does not constitute waiver.
18.4 Entire Agreement: This Agreement supersedes all prior understandings.
